This Privacy Policy (“Policy”) explains how Guardant Health, Inc. (“Guardant”, “we”, “us”, or “our”), as data controller, processes the personal data of job applicants. This Policy applies to personal data we collect on all of our careers websites and/or online job applications that include a link to this Policy, including guardanthealth.com/careers/jobs/, and to the personal data we collect when you provide us with your application in person (together, the “Careers Sites”).

This Policy describes the types of personal data we collect on our Careers Sites, how we may use that data, with whom we may share it, the rights you may have regarding our use of your personal data, and how to assert such rights. If you have any questions or need to access this Policy in an alternative format due to having a disability, please contact us via the methods identified in the Contact Us section below.

We may modify this Policy from time to time and will indicate any such modifications by changing the date at the top of this page. If we make any material changes, we will notify you using the email address or contact information that we have on file for you, or as otherwise required by law.

Personal Data We Collect

The term “personal data” in this Policy refers to information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, to you. This includes information that you provide to us, information that is collected about you automatically, and information we obtain about you from third parties. The definition of personal data depends on the applicable law based on your physical location. Only the definition that applies to your physical location will apply to you under this Policy. It does not include aggregated or anonymized information that is maintained in a form that is not capable of being associated with you.

The types of personal data we may collect, use or process about you will depend upon the nature of job which you are applying for and the location of the job. We may collect the following categories of personal data when you apply for a job with Guardant:

  • Identifiers and contact information, such as your name, address, email address, phone number, IP address, social security number, government identification number, and social media account identifiers
  • Protected classifications, including race, ethnicity, gender, age, veteran status, sexual orientation, and disability status
  • Internet activity information, including IP address and the job postings you view and which you apply
  • Professional or employment-related information, including your work history, previous roles, years of service, skills, professional certifications and other information you provide on your resume/CV
  • Education information, including the college(s) you attended, the degrees you have obtained, and your grade point average
  • Audiovisual information, specifically photographs (if included on a resume/CV or public social media profile, like LinkedIn), CCTV footage (to the extent that you come to the Guardant office for an in-person interview), and other videos recorded as part of the recruiting process
  • Other application and interview Information, such as any personal information you choose to share with us in your interview or application, transcripts or other supporting documentation or to help us coordinate travel for an interview
  • Travel-related expenses, and to the extent incurred during the recruitment process your banking details so that we can reimburse you for such expenses
  • Inferences, specifically other jobs you may be interested in based on applications you have submitted or job postings you have viewed

We are not required to obtain your consent for most of the processing activities that we undertake in respect of your personal data in relation to your job application. In certain circumstances and in certain jurisdictions, we may need your consent to use certain “sensitive” information, such as information about your health or ethnicity, in particular ways. You will never be obliged to give us this consent. Where you have given us consent to collect, use or disclose your personal data in a certain way you may withdraw your consent at any time by contacting us using the contact details provided under the Contact Us section below.

How We Collect Your Personal Data

We may collect your personal data in the following ways: 

Personal Data You Provide to Us 

  • During the application, recruitment, and onboarding process, we may collect, store and process the above categories of personal data directly from you when you submit them to us as part of a job application, when you share information about job postings with others, or when you sign up for a networking event. 

Personal Data We Collect from Other Sources 

  • From Recruiters and Headhunters. We may obtain personal data about you (such as your name, address, phone number, resume/CV, other files or content, and education and employment details) from recruiters and headhunters who submit it to us on your behalf in connection with job postings. 
  • From Public Information. We may also collect your personal data from your public social media profile (on LinkedIn or other similar services) or from your referees to complement the personal data you have provided. We use this information for the purpose of evaluating and verifying your experience and qualifications in relation to specific job requirements. We do so to take pre- contractual steps at your request. If we request references, it is your responsibility to obtain consent from referees before providing their personal data. 
  • From Background Screening Process.  In some jurisdictions where legally permitted, we may collect personal data about you from third parties, such as employment agencies, former employers, and personal and professional references, or public sources to conduct lawful background screenings, to the extent permitted by law. We will provide you with acknowledgement and authorization forms accordingly. 

Personal Data We Collect Automatically 

  • Like many companies, we may use “cookies” on the Careers Sites to obtain certain information by automated means, such as the IP address of the device you use to connect to the Internet and the pages accessed. By collecting this information, we learn how to best tailor our Careers Sites to our visitors.  

Cookies are bits of text that are placed on your computer’s hard drive when you visit certain websites. “Web beacons” (also known as Internet tags, pixel tags and clear GIFs) are computer instructions that link web pages to particular web servers and their cookies. We use cookies, for example, to measure activity on the site and determine which areas and features of the site are most popular. Why We Collect Your Personal Data

We collect, process, store, maintain, and transfer your personal data as we determine reasonably necessary in order to perform our recruitment process and in line with applicable data protection law in the jurisdiction in which you are located. We may use your personal data in the recruitment process to: 

  1. Determine your qualifications, skills, and background for a particular position; 
  1. Determine your right to work; 
  1. Conduct background checks and similar inquiries in compliance with applicable laws;  
  1. Communicate with you during the recruitment process; 
  1. Carry out functions in relation to your future employment; 
  1. Manage and improve our recruitment process; 
  1. Understand, promote, and assist in ensuring that our recruitment process is diverse and inclusive;  
  1. Communicate with you about other job opportunities and networking events; and 
  1. Comply with a legal or regulatory obligation, for example, the law may require us to maintain job applicant information for a certain period of time. 

If you are offered and accept employment with Guardant, the data collected during the application and recruitment process will become part of your employment record.

For individuals who are located in the European Economic Area, the United Kingdom, Switzerland (collectively “EEA Residents’”), Japan, or Singapore at the time their personal data is collected, our legal bases for processing your information under: (i) the EU General Data Protection Regulation (“GDPR”); (ii) the UK Data Protection Act 2018 (“UK GDPR”); (iii) the Swiss Federal Act on Data Protection (“Swiss FADP”); (iv) Japan’s Act on the Protection of Personal Information (“APPI”); or (v) the Singapore Personal Data Protection Act (“PDPA”) will depend on the specific context in the which the personal data is collected and the purposes for which it is used.

These processing activities, which relate to only non-sensitive personal data, are done pursuant to appropriate notice, as given in this Privacy Policy.

How We Share Your Personal Data 

We will not sell, share, or otherwise disclose your personal data for purposes unrelated to those detailed in this Policy without the prior consent of the applicant. To that end, we will take reasonable precautions to allow access to your personal data to only our employees, agents, contractors, or similar entities to the extent necessary for the purposes set out in this Policy. We may share your personal data in the following ways: 

  • With Guardant Employees. Your personal data will be shared with Guardant employees where it is necessary for them to undertake their duties with respect to your potential employment, such as to interview you. 
  • Between Affiliated Entities. Your personal data may be disclosed among our various affiliated entities for the purposes set out in this Policy. 
  • To Third-Party Service Providers.  In the course of our recruitment activities, we may make certain personal data available to third parties who provides services to us to support those activities. We will only do so where such a transfer is necessary, and in accordance with applicable data protection rules. In such instances, your personal data may be made available to the following types of service providers: 
  • Companies that provide or help to operate our applicant database; 
  • Companies that help with relocation support services; 
  • Companies that provide payroll support services; 
  • Companies that help with verification/background checking services; 
  • Cloud services companies that provide hosting, data storage, and other services pursuant to standard terms and conditions that may be non-negotiable; 
  • Companies that help us improve our Career Sites. These third parties may provide data points including how much time you spend on specific pages, which links you choose to click, and data that helps determine user preferences. This information enables us to build and maintain our services with user feedback. These third parties may use cookies and other technologies to collect data on your behavior and devices such as the device type, browser information, and preferred language; 
  • Companies that help manage candidates’ recruitment life cycle via cloud-based recruitment software solutions (known as applicant tracking systems). 
  • Other Third Parties.  We may share certain personal data with third parties who provide professional services (such as attorneys, auditors, accountants, and management consultants, and medical service providers), professional bodies, and regulatory authorities in the normal course of business.  We may also share your personal data with references as part of the recruitment process (provided we obtained your consent).  
  • Legal or Regulatory Requests and Investigations.  We may disclose your personal data to third parties under the following circumstances (i) to comply with relevant laws or regulations, to respond to a court order, administrative or judicial process, such as a subpoena, warrant, court order, or government audit; (ii) in response to lawful requests by public authorities (such as national security or law enforcement); and (iii) as necessary to establish, exercise or defend against potential, threatened or actual litigation (such as adverse parties in litigation). We may also need to share your personal data with tax authorities, courts, regulators, the police, and other governmental authorities where we are required or permitted to do so by law in jurisdictions in which we operate. 
  • Business Transactions.  We may share your personal data with a potential buyer (and its agents and advisors) in connection with any proposed merger, acquisition, or any form of sale or transfer of some or all of our assets (including in the event of a reorganization, dissolution or liquidation), in which case, personal data held by us about you will be among the assets transferred to the buyer or acquirer. Alternatively, we may seek to acquire other businesses or merge with them. If a change happens to our business, then the new owners may use your personal data in the same way as set out in this Policy. 
  • Protection of the Company or Others.   We may share your personal data where necessary to protect us, including to investigate, prevent, or take action regarding possible illegal activities, suspected fraud, safety of person or property, or a violation of our policies. 
  • Disclosures with Your Consent.   We may collect, use and disclose your personal data for other purposes not listed in this Policy. If we do so, we will make it known to you at the time we collect, use or disclose your personal data, and, where required, obtain your consent for doing so. 

Your Rights in Relation to Your Personal Data

Depending on applicable law where you reside or are located, you may be able to assert certain rights identified below with respect to your personal data. If any of the rights listed below are not provided under law for your operating entity or jurisdiction, Guardant has absolute discretion in providing you with those rights.  

Your rights in relation to your personal data are not absolute. Depending upon the applicable law, access to your rights under the applicable law may be denied: (a) when denial of access is required or authorized by law; (b) when granting access would have a negative impact on another’s privacy; (c) to protect our rights and properties; or (d) where the request is frivolous or vexatious, or for other reasons. 

  1. Right to Know/Access. You may have the right to obtain a copy, or a list of categories of the personal data that we hold about you, as well as other supplementary information, such as the purposes of processing, and the entities to whom we disclose your personal data. 
  1. Right to Correct. You may have the right to request that we correct any of your personal data in our records and systems that is inaccurate. 
  1. Right to Delete. Under certain circumstance, you may have the right to request that we delete the personal data that we hold about you. This right is not absolute, and we may refuse such a request if there are compelling legitimate grounds for keeping your personal data, for legitimate purposes, or as required by law. In the event your deletion request is honored, we are required to retain a record of your deletion request as required under applicable law. 
  1. Right to Portability. You may have the right to receive a copy of the personal data we have collected about you in a structured, commonly used and machine-readable format. 
  1. Right to Opt-Out Sale / Right to Opt-Out of Sharing.  If you are a California residents, you have the right to opt-out of: (i) the sale of your personal data to a third party; and (ii) the sharing of your personal data for cross-contextual behavioral advertising to a third party. If you are a job applicant visiting our Careers Sites, we do not sell your personal data, and we will only disclose your personal data, specifically your internet activity information, to third parties for cross-contextual targeted behavioral advertising if you direct us to do so by accepting the cookies and other tracking technology on our Careers Sites. If you would like to change your choice, you can do so by clicking: “Manage consent” on the bottom right of the page. 

Note, to the extent you use a website owned by a third party to submit your personal data to us, such as Indeed or LinkedIn, the personal data you submit is subject to such third party’s privacy policy. 

  1. Right to Limit Use and Disclosure of Sensitive Personal Information.  If you are a California resident, to the extent your sensitive personal data is processed to infer characteristic about you, you may have the right to object to our processing of your sensitive personal data. We do not process any sensitive personal data to infer characteristics about you unless you have consented to such processing. 
  1. Right to Opt-Out of Automated Decision-making. You have the right not to be subject to a decision which significantly impact your rights that is based solely on automated processing (where a decision is taken about you using an electronic system without human involvement). No decision will be made by us which has a significant legal impact on you solely on the basis of automated decision making. 
  1. Right Against Discrimination. You may have the right not to be discriminated against for exercising any of the rights described in this section. We will not discriminate against you for exercising your rights. 
  1. Shine the Light. If you are a California resident, you have the right to ask us for a notice describing what categories of personal data we share with third parties or corporate affiliates for those third parties’ or corporate affiliates’ direct marketing purposes. That notice will identify the categories of personal data shared with third parties and used for direct marketing purposes and the name and address of the third parties that received such Personal data. 
  1. Right to Object. You may have the right to object to processing of your personal data for direct marketing purposes or if we are processing your personal data on the basis of our legitimate interest. 
  1. Right to Restrict. In some jurisdictions, applicable law may give you the right to restrict or object to us processing or transferring your personal data under certain circumstances. We may continue to process your personal data if it is necessary for the defense of legal claims, or for any other exceptions permitted by applicable law. 
  1. Right to Withdraw Consent.  In certain jurisdictions, to the extent the processing of your personal data is based on your consent, you may withdraw your consent at any time. Your withdrawal will not affect the lawfulness of our processing based on consent before your withdrawal. 
  1. Marketing Communications. You may choose to provide us with your email address to allow us to send you emails about other open positions at Guardant. You can stop receiving these emails by following the unsubscribe instructions in emails that you receive. If you decide not to receive these emails, we may still send you communications about your ongoing candidacy for your position at Guardant.  

Applicants from outside the U.S.A. will, if required by applicable law, receive such communications only after having consented hereto. Please note that “unsubscribe” requests may not take effect immediately and may take a reasonable amount of time to receive, process and apply, during which time your personal data shall remain subject to this Policy. 

  1. Right to Lodge a Complaint. In certain jurisdictions, you may have the right to lodge a complaint with your local data protection authority about our processing of your personal data. Contact details for data protection authorities in the European Economic Area are available here, and contact details for the United Kingdom’s ICO are available here.  
  1. Right to Cease. In some jurisdictions, you may have the right to request the cessation of processing if your personal data is used for a purpose that was not originally stated or if your personal data was acquired by fraudulent or other unlawful means. You may also have the right to cease processing and/or transferring of your personal data if: (i) we no longer need to use your personal data; (ii) a data breach has occurred; or (iii) there is a likelihood of infringement of your rights or lawful interests due to our handling of your data. 
  1. Right to Records of Transfers. You may have a right to access a record of transfers of your personal data that was transferred to third parties.

Submitting a Request to Exercise Your Rights 

In addition to methods described above, you may exercise your rights by: (i) by submitting your request via our Rights Request portal; (ii) emailing us at privacy@guardanthealth.com with the subject line “Job Applicant Rights Request”, or (iii) by calling us toll-free at (833) 442-3001. In addition, you may submit a written rights request via mail by sending a letter to us “ATTN: Job Applicant Rights Request” at the address provided in the Contact Us section below. In your request, please clearly indicate which right(s) you would like to exercise.  

Before fulfilling your request, we are required by law to have you verify the personal data we already have on file to confirm your identity. If we cannot verify your identity based on the information we have on file, we may request additional information from you, which we will only use to verify your identity, and for security or fraud-prevention purposes.  

You may use an authorized agent to submit a rights request on your behalf.  If you use an authorized agent to submit requests on your behalf, we will require you to directly verify your identity with us, or have you directly confirm with us that the authorized agent has been authorized to act on your behalf. 

Retention

We will keep your personal data in your personnel file, if you have been hired, for a period as may be required by the laws and regulations of the relevant jurisdiction of your employment. In all other cases, we will retain your personal data for the period of time required by law in the relevant jurisdiction from the date we make an employment decision regarding your job application. Our service providers will retain your personal data solely in accordance with our instructions and will not retain your personal data longer than the periods mentioned above. We take measures to destroy or permanently de-identify personal data if required by law or if the personal data is no longer required for the purpose for which we collected it. 

Security

We understand how important your privacy is, which is why we maintain appropriate physical, technical and administrative safeguards to protect the security and confidentiality of the personal data you entrust to us. These safeguards are designed to protect your personal data from loss and unauthorized access, copying, use, modification or disclosure. 

However, we cannot guarantee that loss, misuse, unauthorized acquisition, or alteration of your data will not occur. Furthermore, we cannot ensure or warrant the security or confidentiality of information you transmit to us or receive from us by Internet or wireless connection, including email, phone, or SMS, since we have no way of protecting that information once it leaves and until it reaches us.  

International Transfers of Personal Data

As a result of the global nature of our business, your personal data may be shared with entities and processed in a foreign country where privacy laws may be less stringent than the laws in your country.  If you are located outside United States and choose to provide information to us, please note that we transfer the data, including personal data, to the United States and process it there. Nonetheless, we will take all the steps reasonably necessary to ensure that your personal data is treated securely and in accordance with this Policy and no transfer of your personal data will take place to an organization or a country unless there are appropriate safeguards in place as required under the applicable data protection laws, and ensuring the security of your personal data maintained.  

EEA, UK and Swiss Personal Data Transfers. To the extent we transfer personal data to another business located in a country that the relevant data protection authority considers to not provide an adequate level of data protection,  we rely on  appropriate safeguards such as:  (i) the use of standard contractual clauses approved by an appropriate regulatory authority, such as the European Commission or the U.K. Information Commissioner’s Office; (ii) applicable Article 49 derogations in specific situations; or (iii) any other compliant transfer mechanism.   

Minors’ Privacy

The Careers Sites and their content are not directed at minors under the age of 16. We will not knowingly collect personal data about individuals under the age of 16 or knowingly allow such persons to register as users. If you believe that your child has registered for the Careers Sites, please contact us at privacy@guardanthealth.com, so that we may delete their information. 

The Careers Sites may contain links to other third party websites for your convenience and information, or you may have been directed to the Careers Sites from a third party website(s). These websites may be operated by companies not affiliated with us. These sites may have their own privacy policies, which we strongly recommend you review if you visit any such websites. We are not responsible for the content of any sites that are not affiliated with us, any use of those sites, or the privacy practices of those sites. 

California Notice at Collection

If you are a California resident, then this Notice at Collection applies to you in accordance with requirements under the California Consumer Privacy Act (“CCPA”). Note, this Notice at Collection applies to the extent you apply for a job with us.   • Identifiers, such as your name, address, email address, phone number, IP address, social security number, government identification number, and social media account identifiers

  • Financial information, specifically banking details so that we can reimburse you for travel-related expenses 
  • Characteristics of protected classifications, including race, ethnicity, gender, age, veteran status, sexual orientation, and disability status. 
  • Education information, including the college(s) you attended, the degrees you have obtained, and your grade point average 
  • Internet activity information, including IP address and the job postings you view and which you apply 
  • Audio, electronic, visual, thermal, olfactory, or similar information, specifically photographs (if included on a resume/CV or public social media profile, like LinkedIn), CCTV footage (to the extent that you come to the Guardant office for an in-person interview), and other videos recorded as part of the recruiting process 
  • Professional or employment-related information, including your work history, previous roles, years of service,  skills, professional certifications and other information you provide on your resume/CV 
  • Inferences, specifically other jobs you may be interested in based on applications you have submitted or job postings you have viewed. 
  • Sensitive personal information, specifically race and sexual orientation, if provided voluntarily for our EEO reporting requirements or otherwise included on your resume/CV 

Purposes for Collection (for more information, see the ​​Why We Collect Your Personal Data section of this Policy: We may use your personal data in the recruitment process to:
